The website accessible at rmf-radio.com (hereinafter "the Site") is published by Be Medias Inc., a joint-stock company incorporated under Quebec law.

RMF Radio is a trademark used by Be Medias Inc. It designates the francophone digital audio media broadcast via the Site, the associated mobile applications, and partner distribution platforms.

02Publication direction

The direction of publication for the Site and the RMF Radio broadcast is jointly assured by the company's co-founders:

The Site is hosted by Netlify, Inc., a provider of web hosting and content delivery (CDN) services.

Live audio broadcasting: the RMF Radio audio stream is broadcast via the RadioKing platform (RadioKing SAS, France). Podcasts are hosted and distributed via SoundCloud (SoundCloud Global Limited & Co. KG, Berlin, Germany).

Professional email: emails associated with the rmf-radio.com domain are managed via Google Workspace (Google LLC, Mountain View, United States).

Domain name: the rmf-radio.com domain name is registered with Wix.com Ltd. (Tel Aviv, Israel).

04Intellectual property

4.1 — Site contents

All content on the Site — including but not limited to: editorial texts, the manifesto, columnists' biographies, visuals, graphic elements, visual identity, logos, design, sitemap, editorial structure, program names, and broadcast audio content — is the exclusive property of Be Medias Inc., or is subject to operating licenses negotiated by Be Medias Inc.

This content is protected by Canadian and international copyright laws, as well as by the international conventions in force, notably the Berne Convention for the Protection of Literary and Artistic Works.

4.2 — Trademarks

The names "RMF Radio" and "La French Connexion", as well as the RMF logo, are trademarks used and operated by Be Medias Inc.

The musical signature "De Nostalgie à Nova" is used by RMF Radio purely as an evocative and descriptive expression to characterize the spectrum of its programming. This usage confers no right on Be Medias Inc. to the trademarks Nostalgie (NRJ Group) and Nova (Radio Nova), which remain the exclusive property of their respective holders.

4.3 — Broadcast musical works

The musical works broadcast on air and in podcasts on RMF Radio remain the property of their respective authors, performers, composers, and rights holders. Their broadcast by RMF Radio is carried out under the licenses applicable to digital radio, particularly those managed in Canada by SOCAN (Society of Composers, Authors and Music Publishers of Canada) and Re:Sound (collective management organization for neighbouring rights).

4.4 — Reproduction and use

Any reproduction, representation, modification, publication, adaptation, or exploitation, in whole or in part, of the Site's elements, by any means whatsoever, is prohibited without prior written authorization from Be Medias Inc.

Any unauthorized use of the Site or its contents is likely to constitute infringement under the Canadian Copyright Act (R.S.C. 1985, c. C-42), as well as the equivalent provisions of French (Intellectual Property Code) and European law.

05Hyperlinks

5.1 — Outbound links

The Site may contain hyperlinks pointing to third-party websites (social networks, partner platforms, press articles, columnists' LinkedIn profiles, etc.). Be Medias Inc. exercises no control over the content of these third-party sites and disclaims any responsibility for their content, availability, compliance with applicable laws, or privacy policies.

The presence of a link to a third-party site does not constitute a recommendation or a formal partnership, unless explicitly stated otherwise.

5.2 — Inbound links

The creation of hyperlinks pointing to the Site's pages is permitted, provided that it does not damage the image of RMF Radio or Be Medias Inc., and is not used for unauthorized or misleading commercial purposes. Be Medias Inc. reserves the right to request the removal of any link deemed inappropriate.

06Liability

6.1 — Site availability

Be Medias Inc. makes every effort to ensure the availability and proper functioning of the Site and audio broadcasting. However, no guarantee of continuous availability can be given. The Site and audio stream may be occasionally unavailable due to maintenance operations, technical incidents, update operations, or causes beyond the publisher's control.

6.2 — Accuracy of information

The information published on the Site is provided for indicative purposes. Be Medias Inc. endeavors to verify its accuracy but cannot guarantee the completeness, precision, or permanent updating of editorial content, public audience data, or information relating to the columnists and partners mentioned.

6.3 — Use of the Site by visitors

The Site user acknowledges having the skills and means necessary to access and use the Site. Be Medias Inc. cannot be held liable for direct or indirect damages resulting from the use of the Site, particularly in the case of viruses, technical failure on the user's end, or misuse of the broadcast content.

07Applicable law

This legal notice is governed by Canadian and Quebec law. In particular, the following provisions apply:

• The Personal Information Protection and Electronic Documents Act (PIPEDA) at the Canadian federal level
• The Quebec Act respecting the protection of personal information in the private sector (commonly known as "Law 25")
• The Canadian Copyright Act
• The Canadian Anti-Spam Legislation (CASL)
